Spineworld's Terms and Conditions

 

These are the Terms and Conditions of access and use of Spineworld, a Playdo AB product. If you do not agree with these terms and conditions, you are not allowed to use Spineworld or any other Playdo Service or Product.

 

Spineworld.com is created and produced by Playdo AB. All the topics below as well as the Privacy Policy, Spineworld Codes of Conducts and other disclaimers documents are parts of this whole agreement and may not be used in part or be excluded from the rest of the agreement. 

 

Please take your time to read the Terms and Conditions of Use of Spineworld as well as its Privacy Policy and Codes of Conduct.

 

Description of Service

Spineworld is a virtual world, a fantastic realm, populated with strange and amazing creatures of the most unimaginable kinds, created by the Playdo AB artists. Spineworld.com provides online adventures and games through internet technology. Spineworld does not require a download or installation of game executable file but is played in the browser, however, some plug-ins are required for the product to be used.

 

Agreement

This text is an agreement between you, as a person or entity, and Playdo AB (creator and owner of Spineworld) a limited company located in Stockholm, Sweden, and governed under Swedish law.

 

You are bound to respect these terms by viewing, accessing, registering or using Spineworld.com. Agreeing to conditions listed here are a prerequisite for you to use Spineworld and Playdo AB's Product(s) and Service(s). Playdo AB recommends that you read these Terms and Conditions carefully.

 

This agreement also bounds you (and your parents if you're under the age of 18) that by uploading or otherwise submitting any materials, or typing texts, in Spineworld or any related websites, you automatically grants (or warrant that the owner of such rights has expressly granted) Playdo AB a perpetual, royalty-free, irrevocable, nonexclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium or technology (now known or hereafter developed or devised) throughout the universe.

 

Warranty

Spineworld (including without limitation any content) is provided “AS IS” and without any warranties of any kind, either express or implied, or statutory.

 

To the fullest extent permissible pursuant to applicable law, Playdo AB disclaims all warranties, statutory, express or implied, including, but not limited to, implied warranties or merchantability and fitness for a particular purpose. Playdo AB does not warrant that Spineworld will meet your requirements, that your access or operation of the service(s) and product(s) or any content accessible through Spineworld will be uninterrupted or error-free, that defects will be corrected, or that Spineworld website or the other sites of Playdo AB (or any server that makes content available) are free of viruses or other harmful components. Playdo AB does not warrant or make any presentations regarding the use or the result of the use of Spineworld in terms of its correctness, accuracy, reliability, or otherwise, or that use of the service(s) and product(s) will not adversely affect you or any other person's use of the computer(s) on which Spineworld is accessed from.  Playdo AB does not hold any responsibility over plug-ins necessary for users to view or access any content or service offered by Playdo (such as Shockwave, Flash and others) and cannot be held responsible for problems with the plug-ins under any circumstances.

 

No oral or written information or advice given by Playdo AB or Spineworld and its moderators and staff members shall under any circumstances create warranty of any kind. Applicable law may not allow the exclusion of express or implied warranties.

 

Membership

By accessing Spineworld for the first time, you are granted a free membership instantly by applying to Spineworld.com. This membership however does not give you full access to all Spineworld's features and tools. Only paying members have full access to all the areas and features in Spineworld. The membership is necessary for you to access services and tools in Spineworld.com.

 

All the information you provide for the membership must be true and valid or you might have your membership terminated in accordance to the content and activity prohibited, listed in these terms. Spineworld.com, and by consequence Playdo AB, may not in any circumstances be held responsible for information provided by users.

 

Personal Use/License

Spineworld grants you, in addition to your membership, with a non-exclusive license to use Spineworld, an online game and website for personal and non-commercial use only.

 

This license also means that you may not:

 

a) redistribute, sell or otherwise copy any product(s) and service(s) offered by Playdo through Spineworld or others;

b) modify, translate or create derivative works based on Spineworld;

c) attempt to decompile, reverse engineer, disassemble or otherwise reduce Spineworld to a human-readable form, except to the extent applicable laws specifically prohibit such restriction;

d) remove any identification, copyright or other proprietary notices; or

e) create other software, product or service that incorporates Spineworld. Without limiting the foregoing, copying or reproduction of the content or software to any other server or location for further reproduction or redistribution is expressly prohibited. You acknowledge that Spineworld is not intended for use in connection with any high risk or strict liability activity and Playdo AB makes no warranty and shall have no liability in connection with the use of Spineworld in any such situations.

 

Safeguarding your password is your responsibility and we recommend you to be very careful not sharing it and especially not making it easy for people to guess it. The support tools are available for help with any situation regarding Spineworld and the access to it, but it is your own whole responsibility to keep information away from anyone but yourself (for example hackers, friends, family members, fans, etc).

 

Playdo AB may not, under any circumstances, be held responsible for the content uploaded, posted, typed or submitted in Spineworld or any other of its Products and Services. The user holds full responsibility for whatever content is posted, uploaded, submitted or in any way added to Spineworld. Parents are responsible for users under the age of 18.

 

The Playdo Crew or communication provided by Spineworld will never ask you for your password via e-mail or any other way (except when you log in on our webpage, of course…). Read Spineworld's Privacy Policy to learn about how we keep your personal information confidential.

 

There are no age limitations in Spineworld. It is you, as a user, that is responsible for leaving accurate personal information. Spineworld and therefore Playdo AB can in no way be held liable for information falsely given by a user in Spineworld.

 

User's age information

Spineworld works in accordance to COPPA (Children's Online Privacy Protection Act of 1998) and holds no limitation of age for Spineworld.com members. We take extra care of users under 13 years of age but we cannot do so if they don't identify themselves as such, and for that, Playdo AB may not be held responsible for any information falsely given by users.

 

In accordance to the Children's Online Privacy Protection Act (http://www.coppa.org/), Playdo AB does not collect information that might locate or identify children under the age of 13 without their parents consent. The information collected by Spineworld from users identified as being of age 13 years old (or younger) is strictly for service access purposes.

 

Spineworld also has a special section for parent's to contact the support team and to read tips about security online. Parents and guardians can access further security information through the Parent's Place section located at: www.spineworld.com/s/parents

 

Spineworld might keep record of users submissions for security purposes, by that meaning submissions, chat rooms logs, private messages and other content submissions might and will be monitored to locate online predators or illegal activities. The content remains confidential except whenever Playdo AB considers necessary to disclose to Legal Authorities.  Moderator and staff members monitors the content posted in Spineworld to keep it friendly and free of sexual, violent and illegal content, but Playdo AB does not hold responsibility for user's posts.

 

Children under 13 years of age must at all times respect the rules regarding inappropriate and prohibited content, proper use and intellectual property rights listed in these terms that their parents are made fully aware of and that the parents accept by clicking on the acceptance links or by allowing their children to access or/and use Playdo services and products. By using, accessing or downloading content from Spineworld.com, you affirm that you, as a user, are over 13 years-old of age or accompanied and supervised by a parent or guardian in case of being of age 12 or under.

 

Content and Activity Prohibited

Listed under this topic are the content and activity prohibited in Spineworld. Solicit, participate, suggest or engage in any of the activity prohibited will lead you to suspension or ban from Spineworld. So please read carefully and notice that the following activities are strictly forbidden:

 

  1. Vulgarity
    • Use of bad and offensive words
    • Use of offensive usernames
    • Use of logos / pictures / text plates with abusive or bad language
  2. Sexually Explicit Content
    • Add, display or upload sexually related content (text, images or videos) for example nudity, sexually appealing content, pornography, etc
    • Solicit or participate in any kind of cybersex or similar activities
    • Ask for or offer webcam sessions
    • Discussing or suggesting sexual activities
    • Cyber-rape
  3. Disruption
    • Spam (virus, adds, phishing, chain letters, junk mail, mass mailing)
    • Attempt to disconnect another user
    • Any activity to disrupt another player's online experience.
    • Abuse the report tools.
    • Trick underage users to give out personal information.
    • Threaten other members or display explicit violent content.
    • Spam or flood the chats with repeated statements or messages.
  4. Harassment
    • Bullying
    • Intimidate or harass (sexually or in any other way)
    • Spread rumors about a player or Playdo services and/or employees
    • Create usernames to harass another user
    • Threaten, embarrass or distress another user by your behavior.
    • Add, upload or display harassing images or images in other ways abusing
  5. Personal Identifying Info
    • Give out or ask for full name, address, phone numbers, locations, meeting and hangout places.
    • Ask for personal details that take the experience in Playdo from being virtual to be personal.
    • Give out or try to get information that can be used to locate another user or his/her family, friends or a Playdo employee.
  6. Hate Speech
    • Have prejudice of any kind and discriminate other people by their religion, color of skin, beliefs, likes, dislikes, gender or sexual preferences.
    • Racism, discrimination, hate crimes, excessive nationalism and intolerance.
    • Bigotry.
  7. Illegal Activity / T&C Violation
    • Use any kind of third party software or spyware to disrupt or interfere in another user's online experience.
    • Promote the use of drugs.
    • Upload, display or suggest any content that promotes illegal activity.
    • Make any kind of violent threats.
    • Disclose or share any kind of confidential Playdo information.
    • Sell or trade accounts.
    • Say that you work for Playdo or try to fool another user to believe so.
    • Practice any kind of crime.
    • Advertise or promote commercial products/services.
  8. Scamming & Fraud
    • Phishing (asking for passwords or account details).
    • Keylogging.
    • Offer free accounts, items or any kind of credits in any way.
    • Credit Card fraud.
    • SMS text fraud.
    • Landline fraud.
    • Any credits fraud.
    • Pretend that you are someone else.

 

It's also important that you keep in mind that you may not remove, alter and obscure any property notices, labels or marks from the Product(s) and Service(s) offered by Playdo AB. You may not alter this license agreement or any of the installed documents and files.

 

The content you post in Spineworld is stored into our database and it is part of Spineworld content. However, Playdo AB will not publish or make it accessible outside Spineworld without the user's consent. Playdo reserves the right to delete inappropriate content or forward any illegal content to Law Enforcement and Legal Authorities.

Intellectual Property Rights

 

Copyright Policy

Copyright does not mean that you have the right to copy. It means someone has the right NOT to let you copy their creations and they have the law on their side. Spineworld and any of Playdo AB Services and Products are protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

 

This also means that you are not allowed to decompile, disassemble, modify, translate, adapt, reverse engineer, or sublicense any service or product offered by Playdo AB.

 

You are also prohibited from reproducing, modifying, distributing, selling, publicly displaying, and/or otherwise exploiting any content (including your own derivative works) accessed on or through Playdo unless permitted by written agreement with Playdo.

 

Advertisements

When you accept these conditions listed here, you affirm to agree and understand that Playdo will advertise and send relevant information to your e-mail. But we will not let anyone but the Playdo Crew to have access to your e-mail address and personal details, unless when authorized by you.

 

Playdo AB does not take any responsibility and can in no way be held responsible by any third parties information or advertisement.

 

Contests, Sweepstakes and Promotions

Spineworld may have contests, sweepstakes or promotions that are sponsored by Playdo AB or a third party company. To qualify for entry in that contest or promotion, we may ask you to provide personal information. If we plan to share that information with the sponsor(s), partner(s) or others, we will provide a statement to that effect in the contest, sweepstakes or promotion terms. No other Spineworld members will have access to such information.

 

User IP rights

An Internet Protocol or IP address is a unique string of numbers (like a bar code or an ID), that your server and Internet Provider gives to your computer. Web servers automatically identify your computer by its IP address. These are used only to help us find and fix problems with our server, to administer the site and to enhance your experience online. Your IP address may also be used to gather broad demographic information. Playdo AB will never share your IP address with anyone else by accessing Spineworld in any other case than co-operating with necessary law enforcement agencies, if we suspect you are committing illegal or prohibited activity.

 

Jurisdiction

Spineworld is a product owned and developed by Playdo AB. All rights reserved.

 

The laws of the Kingdom of Sweden govern this agreement, without giving effect to conflict of laws provisions. The court of Stockholm, Sweden, have exclusive jurisdiction over all disputes relating or arising from the execution or performance of this agreement unless Playdo AB wishes to initiate legal proceedings in your home legal district. In all judicial actions, arbitrations, or disputes resolution methods, the parties waive any punitive damages.

 

Account Inactivity

If your account is not accessed for 3 months, it'll be set into the inactive mode. After 3 months of inactivity, the account will be automatically deleted. So after 6 months without accessing your account, it'll be terminated automatically.

 

Termination; Cancellation

Spineworld membership is yours. If you by any reason want to close, cancel or terminate your account there are only a few steps to take. To terminate your account, go to your account page and follow the instructions.

 

Playdo AB may also terminate your membership and your account if you are considered a threat or disturbance to other users. Your account might be terminated if you disrespect this agreement or fail to execute any agreed payments towards Playdo AB. Spineworld (or Playdo AB) reserves the right to not give any further explanation about account termination or user ban. This License Agreement may be voluntary terminated by either of the Parties providing that the terminating Party have remained in compliance with each of the Terms of this License Agreement at all times prior to termination. Notice of termination shall be made by e-mail.

 

Playdo also reserves the right to disclose information about its users considered suspicious of illegal activities to law enforcement and authorities.

 

Disclaimer's update

This agreement is updated from time to time in order to attend to the new features and services of Spineworld. By using, accessing or registering to Spineworld.com you also agree to be bound to any changes to this Agreement. Please come back often to review these terms.
